FORT HAMILTON ACADEMY SOCCER CAMPS RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, PLEASE READ CAREFULLY
INTRODUCTION: This agreement is designed to outline the risks associated with participation in soccer programs organized by Fort Hamilton Academy Soccer Camps. It also sets forth the responsibilities and legal obligations of the parent or guardian registering a child/ward for participation. By signing this agreement, you accept and assume all risks associated with these activities and release Summit Soccer Camps and its affiliates from liability.
ASSUMPTION OF RISKS: As the parent or guardian of the player being registered, I understand and acknowledge that:
1. Voluntary Participation:
• My child/ward is voluntarily participating in soccer programs organized by Fort Hamilton Soccer Academy Camps.
2. Risks of Injury: Participation in soccer programs involves numerous risks, dangers, and hazards, including but not limited to:
• Health Risks: Overexertion, dehydration, fatigue, lack of fitness or conditioning, traumatic injuries, bacterial infections, rashes, and transmission of communicable diseases (including viruses, bacteria, and parasites).
• Environmental Risks: Defective or unsafe playing surfaces, falls, collisions with objects or persons, extreme weather conditions, and travel-related incidents.
• Equipment Risks: Failure of equipment, negligent design or manufacturing, improper use, and lack of instructions regarding proper operation.
• Contact Risks: Contact with soccer balls, equipment, or other participants that may lead to injuries such as concussions, fractures, or spinal damage.
3. Player Conduct:
• My child’s conduct and the conduct of other participants can create additional risks, including physical altercations or other incidents resulting in harm or injury.
4. Acknowledgment of Hazards:
• I have discussed these risks with my child/ward, and we fully understand and accept them.
RELEASE OF LIABILITY AND WAIVER OF CLAIMS: In consideration of Fort Hamilton Soccer Academy Camps allowing my child/ward to participate in soccer programs, I hereby agree as follows:
1. Waiver of Claims:
• To waive any and all claims that I or my child/ward may have now or in the future against Fort Hamilton Soccer Academy Camps and its directors, officers, employees, agents, volunteers, members, participants, sponsors, and affiliates (collectively referred to as “the RELEASEES”).
2. Release of Liability:
• To release the RELEASEES from any liability for any loss, damage, expense, or injury, including death, resulting from participation in soccer programs, including but not limited to:
• Negligence on the part of the RELEASEES.
• Breach of contract or warranty by the RELEASEES.
• Failure to provide proper safety measures or adequately maintain equipment or facilities.
• Breach of statutory duties or obligations, including those under the Occupiers Liability Act, R.S.B.C. 1996, c. 303.
3. Assumption of Responsibility:
• To assume full responsibility for all risks associated with Fort Hamilton soccer academy soccer camp, including personal injury and property damage
4. Indemnification:
• To hold harmless and indemnify the RELEASEES from any and all liability for damage, loss, or injury to third parties resulting from my child’s participation in Fort Hamilton soccer camp programs.
SAFETY ACKNOWLEDGMENT: I acknowledge that Fort Hamilton Academy Soccer Camps and its staff have provided instructions, guidelines, and advice regarding the safe participation in soccer programs. I understand that:
• Fort Hamilton Academy Soccer Camps cannot guarantee the safety of participants in all circumstances. I am responsible for ensuring that my child/ward follows all safety instructions and uses equipment appropriately.
INSURANCE NOTICE: I understand that Fort Hamilton Soccer Academy Camps carries limited liability insurance and that my child may or may not be entitled to coverage for injuries or damages depending on the terms and conditions of the policy. I also acknowledge that I am encouraged to carry my own health and accident insurance for my child.
PARENT/GUARDIAN CONSENT:
By signing this document, I confirm the following:
1. I am the legal parent/guardian of the child/ward being registered.
2. I have read, understood, and agree to the terms outlined in this Agreement.
3. I acknowledge that participation in soccer programs is voluntary and involves significant risks.
4. I freely accept and assume all risks on behalf of my child/ward.
